S-X Open International reserves the day (Sunday, November 17, 2019) after the originally scheduled event date on November 16, 2019, in case there is a need to reschedule due to wet weather. Entry to the S-X OPEN Auckland Event is conditional upon agreement to and compliance with the following terms and conditions.
By entering the S-X OPEN Auckland Event you the pass holder (“You”) irrevocably agree to be bound by these terms. You also agree to abide by any lawful direction given by AME Management Pty Ltd (“Event Manager”) its agents, employees or contractors and any venue or security staff. You understand that Motor Racing Events are dangerous, even when you are a spectator.

Motor Racing is DANGEROUS, and all persons attending this track do so entirely at their own risk. It is a condition of admission that all persons having connections with the promotion and/or conduct of the meeting, including the owners of the land, and the riders and owners of vehicles and passengers in vehicles, are absolved from liability arising out of any accidents causing damage or personal injury to spectators or ticket holders except where due care and skill has not been exercised.
The carrying or consumption of alcoholic beverages within the pit area is prohibited by order of Motorcycling New Zealand, Motorcycling Australia & FIM Oceania.

To the extent permitted by Law, S-X Open International and its related bodies corporate, Mt Smart Stadium (and their officers, employees and agents) shall not be liable for any loss, damage, expenses or injury (including but not limited to indirect, special, incidental, exemplary or consequential loss) arising out of or in connection with patrons’ attendance at the Event.
Guests are required to conduct themselves in a manner acceptable to S-X Open International at all times. S-X Open International and Mt Smart Stadium reserve the right to refuse entry or to remove any guest who is not behaving in an acceptable manner.
Tickets will be distributed via express post 2-3 weeks prior to the event. Tickets will not be sent until full payment pay been received.
1.2 Ticketmaster sell tickets as an agent for and on behalf of the “Presenter” (the party who presents the event, which may include a promoter or producer or venue, as the case may be, details of which are available from Ticketmaster). Any representations made by the Presenter with reference to the Event or performance at any time and any associated complaints or claims are the responsibility of the Presenter and not Ticketmaster.
1.3 All Customers attending an Event or performance must hold a valid ticket for the same. Late arrivals may result in non-admittance until a suitable break in performance.
1.4 Nothing in these policies is intended to limit or exclude Ticketmaster’s liability, or the liability of a Presenter, under applicable consumer law including the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.
1.5 This ticket is sold subject to the Presenter’s conditions of sale and also (to the extent that they are not inconsistent with the Presenter’s conditions of sale), the following:
2.1 All ticket prices for events that occur in New Zealand are stated in New Zealand Dollars. Ticketmaster.co.nz accepts several methods of payment to accommodate your needs, including: American Express, MasterCard and Visa. 3. Who You Are Buying From
3.1 Ticketmaster acts as the agent to those who are promoting or otherwise providing the events for which you purchase tickets (“Event Providers”). When you purchase a ticket for an event that is located in New Zealand, then Ticketmaster NZ will be handling the transaction and collecting payment for the Event Provider, and if the tickets are sent they will be sent from New Zealand, regardless of whether you are making your purchase on Ticketmaster.com.au or Ticketmaster.co.nz and regardless of what country you live in. When you purchase a ticket for an event that is located in Australia, then Ticketmaster Australia will be handling the transaction and collecting payment for the Event Provider, and if the tickets are sent they will be sent from Australia, regardless of whether you are making your purchase on Ticketmaster.com.au or Ticketmaster.co.nz and regardless of what country you live in.
4. Pricing and Availability
4.1 Ticketmaster.co.nz sells tickets on behalf of promoters, teams, bands and venues, which means Ticketmaster.co.nz does not set the ticket prices or determine seating locations. Tickets are generally sold through several distribution points, including online, Contact Centres, Outlets and box offices. Most distribution points generally access the same ticketing system and inventory. Therefore, tickets for popular events may sell out quickly. Occasionally, additional tickets may be available prior to the event. However, Ticketmaster.co.nz does not control this inventory or its availability.
5. Order Confirmation
5.1 If you do not receive a confirmation number (in the form of a confirmation page or email) after submitting payment information, or if you experience an error message or service interruption after submitting payment information, it is your responsibility to confirm with your Customer Service Department whether or not your order has been placed. Only you may be aware of any problems that may occur during the purchase process. Ticketmaster will not be responsible for losses (monetary or otherwise) if you assume that an order was not placed because you failed to receive confirmation.
6. Processing Fees
6.1 Tickets purchased on the Site are typically subject to a per ticket charge and a non-refundable per order Payment Processing Fee. In many cases, delivery prices will also be charged. The per order Payment Processing Fees are calculated as a percentage of the total order value and apply where payment is made via Credit Card, Debit Cards and Gift Cards. The Payment Processing Fee includes (but is not limited to) credit and debit card fees and expenses, administration and associated infrastructure costs for providing these payment mechanisms.
7. Amount of Tickets Per Customer or “Ticket Limits”
7.1 When purchasing tickets on Ticketmaster.co.nz you are limited to a specified number of tickets for each event (also known as a “ticket limit”). This amount is included on the unique event page and is verified with every transaction. This policy is in effect to discourage unfair ticket buying practices.
8. Cancelled Events
8.1 Occasionally, events are cancelled or postponed by the promoter, team, band or venue due to weather conditions or situations affecting the staff or audience. When this occurs, ticketmaster.co.nz makes every effort to ensure you receive a prompt refund if applicable. If an event is cancelled, please Contact us for information on receiving a refund. If the event was moved or rescheduled, the venue or promoter may set refund limitations. Contact us for exact instructions. Please make sure to include/provide your ticketmaster.co.nz account number so we can expedite your refund if applicable. If you purchased the ticket(s) at a ticket centre, you will need to return the ticket(s) directly to the ticket centre where you purchased the ticket(s).
8.2 In the event that a Presenter authorises ticket refunds, they will be issued only to the original purchaser or to the original credit card used for the purchase.
8.3 Nothing in this Purchase Policy (including specifically, this clause) shall limit Ticketmaster’s or a Presenter’s liability for any breach of the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 (including any liability for consequential loss suffered by a consumer that cannot be excluded) or will or purport to limit any consumer’s rights that cannot be limited by New Zealand Law.
9. Opening Acts
9.1 Opening acts or guests may sometimes tour with headlining performers. Ticketmaster is not always made aware of opening acts or the length of their performances. These opening acts are subject to change or cancellation at any time without notice. No refund will be owed if an opening act is changed or cancelled.
10. Refunds and Exchanges
10.1 Before purchasing tickets, carefully review your event and seat selection. Ticketmaster does not issue an exchange or refund for a lost, stolen, damaged or destroyed ticket (including where a ticket does not arrive in the mail) unless (a) Ticketmaster can identify at the Venue the actual seat corresponding to the ticket for that event, or in the case of a general admission ticket, Ticketmaster is able to identify (acting reasonably) and cancel the relevant ticket, and (b) you give Ticketmaster a reasonable amount of notice ahead of the event that the ticket has been lost, stolen, damaged or destroyed, in which case Ticketmaster will issue a replacement ticket to you for a reasonable administration fee. A change in personal circumstances does not entitle a ticket holder to return or exchange a ticket.
10.2 Ticket holders acknowledge that the Event Partner reserves the right to remove or replace any motorbike rider who is unable
to compete, ride or attend the Event at any time in their absolute discretion, without notice to ticket holders. For the
avoidance of doubt, ticket holders will not be entitled to a refund or exchange if any motorbike rider is removed from the
Event lineup for any reason.
11. Billing Information Verification
11.1 Orders are processed only after a billing address, and other billing information, has been verified. Occasionally, we receive incorrect billing or credit card account information for a ticket order that can delay processing and delivery. In these cases, Ticketmaster customer service will attempt to contact you, using the information provided at the time of purchase. If Ticketmaster is unable to reach you after its initial attempt, Ticketmaster may cancel your order and may sell your tickets to another customer.
12. Delivery of Tickets and Venue Pick Up
12.1 If you have selected delivery through the mail, please allow at least 14 days after your order is made to receive your tickets. Ticketmaster sends tickets via New Zealand post in New Zealand to the billing address of the charge card holder. Occasionally, we receive incorrect billing or credit card account information for a ticket order that can delay processing and delivery. Tickets delivered through Venue Pick Up are typically available one hour prior to the event start time. You will need to present your ticketmaster.co.nz confirmation number, the credit card used to purchase tickets and picture identification. Some events do not have Venue Pick Up (in this case you will not get Venue Pick Up as a delivery option when ordering tickets).
13. Multiple Browser Windows
13.1 When ordering tickets online with Ticketmaster, please ensure you are looking for tickets and placing an order using only one browser window. Looking up tickets using multiple browser windows could result in losing your tickets or timer expiration.
14. Limitation of Liability
14.1 Balls and other objects may fly into the spectator area during an event. Despite spectator shielding, injury can occur. Stay alert at all times before, during and after play or performance. If struck, immediately ask usher for directions to a medical station. By purchasing a ticket through Ticketmaster, you agree to the terms of this Purchase Policy on behalf of yourself and any accompanying minor. You assume all risks incidental to the event for which a ticket is issued, whether before, during or after play or performance, except that nothing in this section limits your rights and remedies under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986
15. License; Ejection and Cancellation; No Redemption Value
15.1 Event Providers and Venues reserve the right, without refund of any amount paid, to refuse admission to, or eject, any person whose conduct management deems disorderly, who uses vulgar or abusive language or who fails to comply with either the Event Provider’s rules or Venue’s terms & conditions of entry. A ticket is a revocable licence and breach of terms or rules will terminate your license to attend the event without refund. A ticket is not redeemable for cash.
15.2 The Presenter reserves the right to add, withdraw or substitute artists provided that it does not cause a fundamental change in the characteristics of the event for which tickets are purchased; vary advertised programmes, seating arrangements and audience capacity, refuse admission with reasonable cause or to request a customer leave the venue if disrupting others. Please also see the clauses headed “Cancelled Events” and “Opening Acts” for further information.
16. Recording, Transmission and Exhibition
16.1 You agree not to record or transmit, or aid in recording or transmitting, any description, account, picture, or reproduction of the event. You grant permission to utilize your image, likeness, actions and statements in any live or recorded audio, video, or photographic display or other transmission, exhibition, publication or reproduction made of, or at, the event (regardless of whether before, during or after play or performance) in any medium or context without further authorization or compensation.
16.2 Cameras, video and audio recording devices, mobile phones and pagers may not be permitted in certain venues. The Presenter may request that all pagers and mobile phones be turned off before entry.
16.3 The Presenter reserves the right to remove a ticket holder from the event without compensation for breach of any rules in this clause.
17. You Are Subject to Search
17.1 You and your belongings may be searched on entry. You consent to such searches and waive any related claims that may arise. If you elect not to consent to such searches, you may be denied entry to the event without refund or other compensation. Under certain facility rules, certain items may not be brought into the premises, including without limitation, alcohol, drugs, controlled substances, cameras, recording devices, bundles and containers.
18. Unlawful Re-Sale of Tickets; Commercial Purposes
18.1 The Major Events Management Act 2007 (‘Act’) places restrictions on the value at which tickets to events declared as major events under the Act can be sold or traded. A breach of the relevant provisions of the Act may lead to liability to pay a fine.
18.2 A ticket shall not be used for advertising, promotions, contests or sweepstakes, unless formal written authorisation is given by the Presenter, provided that even if such consent is obtained, use of Ticketmaster’s trademarks and other intellectual property is subject to Ticketmaster’s express consent.
